Trouble deleting an application

Ok, the other day i tried to download a No-cd crack for Hitman Contracts, I have the game but my cd is scratched to hell and won't run. Anyway one thing that I downloaded is an application, it doesn't run, claims to be 0 bytes in size but when i try and delete the thinf it says "cannot delete, being used by another person or program", but i have no idea whats using it, or how to find out.

It's sitting on my desktop, I can't move or delete it, any help on how to get rid of it, or the names of any programs that could do it would be much appreciated

Boot into Safe Mode, then try and get rid of it.
