The status of Atari is very complex. And Infogrames bought Atari in 2009. Infogrames became Atari Entertainement.
I read an article last year: Atari's lawyers woke up in recent days with the intention of defending the Atari brand, including by addressing his biggest fans.
2 fans sites released old games for free. This was not legal but tolerated by Atari because the games weren't not sold anymore on none support and the after-sales service has abandonned.
With the democratisation of games on mobiles plateforms, Atari decided to re-edited his classic games. He does not seem to have decided to attack sites where the games were Atari's long been available on abandonware sites, which have made a specialty of compiling the old hits lost. So, the society is curious. they don't attack abandonware sites but Atari's fans sites.
In France, a concensus has been found to define the term of abandonware:
1- The abandonware is to offer free downloads of old games that are no longer commercially available to date, and have been for a long time, and whose service was also abandoned.
2-- The game must be relatively old (minimum 5 years).
3-It should no longer be marketed, at least in its French version. If the game is still sold but abroad, a consensus within the team may lead to what the game is still broadcast on Abandonware France in its French version.
4- The beneficiaries were not positioned against its free distribution.
Legally, After how long a game falls into the public domain?
In fact, this term will first depend on who owns the rights.
- If the game is for the author of the game, then the game is protected throughout the life of that person, plus 70 years.
- If the game belongs to a company, then it is protected for 70 years after the release of this game
So, what about GP4?
Here, the points 1-2-3 are respected but officially, Atari did not wish to comment on abandonware.
As Atari is a french company since Infogrames have bought it, we can suppose, regarding abandonware definition that they just have to give their authorization for the game to become an abandonware. But they didn't say they are against it. They should be more precise.
Personaly, I think they should give it to their fan, now... The game is old, not sold anymore, none service if the disc is broken, difficult to find and I would say that it belongs only to its fans now, thanks to updates, tools, mods, tracks etc.... Grand Prix 1 & 2 are officially abandonwares.
