What a story Dan - keep us updated, this is just shocking!

I have to ask the question though, why the hell did you agree to live in the place in the first place ;)?!!!!

You have gone through a real battlefield, Dan. Anyway, it's good that the things started finally moving in the right direction.

Everytime I read such things I thank God for letting me stay at home without the necessity of moving out for the period of my university studies. I still have got two semesters to cover and that will be it.

Booya Dude!

And with that I hope the landlord gets screwed even more. Excellent result! :D

Update!

My deposit has not been returned. Apparantly I breached the letting agreement terms by moving out unexpectedly and not paying the agreed rent for the contract duration.

Bahahah. I asked if they would be so kind as to end this scenario for all the problems induced by the property, return my deposit in full, and that this would be the end of matters. Simple.

Afraid not.

The deposit protection scheme (which is now UK law to do) held by a deposit protection company was filed the same day (after) my dad stormed the letting agency office and tore out the only original of the contract from the office desk (which didnt have my signature, for evidence). That makes them up $hit creek alone! LOL!

I was told by the agency they filed a police harrassment complaint on my dad for 'abuse' (telling them to STFU) and theft. LOL. News to us, surely he'd be contacted LOL. It's their word versus ours. Fools. Unless it was videos, whch again, we would have been questioned by now and chased up, surely!?

Either way, I nicely asked if I could just have my full deposit returned, and leave it there.

They aren't having it.

The landlord was in the office, of all times, the time I phoned. Rare treat. Instead of answering the phone questions herself, the dippy agency woman said 'would you like to speak to the landlord, hes actually here now'. A polite, 'no, I am alright thanks' was ignored.

I was greeted by a lovely 'see you next tuesday' themed abusive jingle, and was hung up on. Lol. Wish I recorded it! I will do next time.. and not tell him, until the end! HAAHAHAH.

The case continues...

So I told them...literally... 'yippie kai yay... see you in court!! adios amigos'.

Call me a pedant if you like, but the Housing Act 2004 applies to England & Wales only, it's a devolved matter in Scotland.

Would hate for people to get incorrect law information from GPG, 'cos we all know people take these forums as gospel ;-)

Yup Peat. I couldn't do anything until the contract ended with the other tenants, and that didn't happen until the first week of September just gone.

Game on! I am going to screw him over for every little thing that I was kind enough to give him the benefit of the doubt with. Starting with the fact he almost killed me with self-taught electrical installations, using internal mains cabling for outdoor use without a sheath, and then generally moving onto the simple laws that his property has been let illegally with occupant numbers, which, given council reports I have copies of, he failed to ammend within the time required. To name just a few things...

He is looking at a £10k council fine alone for this breach on our house. Might I add he owns MULTIPLE properties, the next door being a 12 bedroom unit that was illegally converted from a storehouse LOL.

Sucker is going to wish he just paid me the deposit.

What odd timing - today, after 10 months, god knows how many letters, and much research, we finally got our deposit back from our old flat - the landlord tried to claim brand new carpet in replacement for a hole in used carpet that wasn't even there. Turns out 14 days' notice of a court claim does the job that other letters don't. I even had my claim written up!

So, good luck to you - not that you'll need it, but I am happy to pass on any knowledge that you might find useful :)
