problem solved.
I was using tony's 2009 empty mod previously.
now I make a normal CSM mod and it does not have that problem anymore.
guess that the tweaker co-ords in tony's mod need to be adjusted for other mods.

Open gp4 tweaker and select a car that is perfectly configured with capecetes and wheels, home you will find the right setup and just get this configuration and copy it to another car that mangled and ready.

Example

Tyres positions:
FrontRight = 0.70000, -0.23000, 1.20000
FrontLeft = -0.70000, -0.23000, 1.20000
RearRight = 0.70000, -0.23000, -2.05000
RearLeft = -0.70000, -0.23000, -2.05000

Rear_light_on position (with rearlight.ini file / Gp4Tweaker):
x = 0.0000, y = -0.1499, z = -2.5372
